Conditions Of Sale
Steel King is a trading name of Steel Mesh Ltd.
These Conditions of Sale apply to goods and services supplied by Steel Mesh Ltd trading as Steel King.
Nothing in these Conditions limits any statutory rights that cannot legally be excluded or restricted.
1. Orders And Credit
All orders are subject to acceptance by Steel King.
Where an order is based on a quotation, we may accept the order on the understanding that the quantities and services quoted will be ordered as stated.
Goods will only be supplied up to the value of payment received or within an agreed credit limit.
Any credit facility is provided at our discretion. We may request information reasonably required to establish or maintain a credit facility and may amend, suspend or withdraw credit facilities where appropriate.
2. Delivery Times
Any delivery dates or times given are estimates unless expressly agreed otherwise in writing.
We will make reasonable efforts to meet estimated delivery times, but delivery times may change due to circumstances including stock availability, transport conditions, supplier delays and other matters outside our reasonable control.
3. Delivery And Access
Where goods are collected by or on behalf of the customer, responsibility for the goods will normally pass to the customer once the goods have been loaded onto the customer's vehicle.
Where goods are delivered to a site or premises:
- the customer must provide suitable and safe access
- the customer must ensure suitable unloading arrangements are available unless HIAB delivery has been arranged
- standard deliveries are normally kerbside
- our driver or delivery provider may refuse to enter or unload at a location considered unsafe or unsuitable
- where a person at the delivery location directs where goods should be unloaded, we may reasonably treat that person as authorised to give those instructions
Where delivery cannot be completed because of access restrictions, nobody being available, inadequate unloading arrangements or another issue outside our control, additional transport, storage, unloading, reloading or redelivery charges may apply.
4. Failed Or Refused Delivery
Where goods have been made available for delivery but cannot be delivered or are refused without a valid reason, we may charge reasonable costs incurred as a result.
These may include delivery, storage, redelivery, return transport and applicable restocking charges.
Any specific aborted delivery charges will be stated in our Delivery Policy or communicated before the relevant service is provided where applicable.
5. Inspection Of Goods
Customers should check goods as soon as reasonably possible after delivery or collection.
Any visible shortages, damage, incorrect goods or apparent defects should be reported to us promptly.
Where possible, please provide photographs, delivery information and your order number so that we can investigate.
For business customers, we ask that visible issues are reported within 7 days of delivery or collection.
Nothing in this condition limits statutory rights that apply to consumers.
6. Faulty, Damaged Or Incorrect Goods
Where a valid claim is established, we will provide an appropriate remedy in accordance with applicable law.
Depending on the circumstances, this may include:
- replacement goods
- repair
- correction of defective workmanship
- collection
- refund
We must be given a reasonable opportunity to inspect or investigate the goods where necessary.
7. Prices
Prices are those agreed when the order is accepted, subject to any subsequent changes requested by the customer.
Quotations are valid for the period stated on the quotation.
We reserve the right to correct obvious pricing, typographical or technical errors before fulfilling an order.
8. Steel Appearance
Steel may naturally display characteristics including:
- light surface rust
- mill scale
- colour variation
- marks associated with manufacture, storage or handling
These characteristics will not normally constitute a defect where the goods remain suitable for their intended purpose and comply with the relevant agreed specification.
9. Payment
Unless an approved credit arrangement has been agreed, payment must normally be received before goods are processed or dispatched.
Credit-account customers must pay invoices within the agreed payment terms.
Where sums become overdue, we may:
- suspend further orders or deliveries
- withdraw credit facilities
- charge interest and reasonable recovery costs where permitted by law
10. Representations And Variations
Any material variation to an agreed order or contract should be confirmed in writing.
Statements made by employees, agents or representatives will not alter these Conditions unless the variation has been authorised or confirmed by Steel King.
11. Governing Law
These Conditions and contracts entered into with Steel Mesh Ltd are governed by the laws of England and Wales.
Nothing in this section removes any rights a consumer may have regarding the courts or laws applicable to them.
12. Call Recording
Telephone calls may be recorded for training, quality assurance, monitoring, dispute resolution and security purposes.
Recordings will be handled in accordance with our Privacy Policy and applicable data protection requirements.
13. Product Standards And Certification
Where stated in the product specification, steel will be supplied in accordance with the relevant British Standard or other applicable specification.
Certain products supplied directly by third-party manufacturers or suppliers may have different certification arrangements.
Where certification or testing is important to your intended use, please confirm your requirements with us before ordering.
Additional testing, certification or documentation may incur an additional charge.
14. Suitability Of Goods
Business customers are responsible for ensuring that products ordered are appropriate for their intended use and that the correct quantities, dimensions and specifications have been selected.
Nothing in these Conditions excludes warranties or obligations that cannot legally be excluded.
15. Retention Of Title
Risk in the goods will normally pass to the customer upon delivery or collection, subject to applicable law.
For goods supplied to business customers on credit, ownership will remain with Steel Mesh Ltd until the amounts due for those goods have been paid in full.
Until ownership passes, the customer must take reasonable care of the goods.
Where payment remains outstanding and permitted by law, Steel Mesh Ltd may require unpaid goods to be identified and kept separately and may seek recovery of those goods.
16. Bespoke And Fabricated Goods
Goods that are cut, bent, fabricated, manufactured or otherwise produced to a customer's specific measurements or requirements cannot normally be cancelled or returned once production has started, unless they are faulty, damaged or not supplied in accordance with the agreed specification.
Customers are responsible for checking measurements, quantities and specifications before confirming their order.
17. Returns And Refunds
Returns, cancellations and refunds are governed by our separate Returns & Refunds Policy.
Nothing in that policy or these Conditions affects statutory rights relating to faulty, damaged or incorrectly supplied goods.
